Full Version: Is The Latest Health Care Bill Constitutional>?

When people want to drive a car in the US they must have Auto Insurance because Driving is a privilage regulated by the goverment who ( with our tax dollars ) builds and maintains roads.

Just covering that because I'm pretty sure someone will bring that up. Now how can the goverment force people to buy into health care insruance. I feel its not constitutional for the goverment to force me to buy anything. Mind you driving is a privilage and in order to recieve that privilage you must have auto insurance however my health be it good or bad is only benefitting ME or hurting ME, not anyone else.

How can the goverment force someone to buy insurance>? The only way for obamas bill to work and not put insurance companies out of business would be to have EVERY person buying in to health insurance. As it stands right now the profit margins for insurance companies are VERY low compared to other types of corporations out there and when you look at the money they fork out for peoples medical bills.. Regardless they have a right to make a profit, otherwise why work, why create or make jobs for people needing work?


So I ask this, is forcing US citizens to buy health care Constitutional>?

On a side note the IRS will be enforcing people to buy it, much like they enforced the rules durring "prohibition". On another side note the majority of US citizens in every poll were against this bill passing, there will be a price to pay come November

Well, there is a list of those that Don't have to purchase it which includes: Congress, Congressional Staff, OBAMA, Amish and .. Get This .. MUSLIMS!

On that ground alone .. It's unconstitutional!!

You forgot illegal aliens get free medical with out paying also. The constitution means nothing to a socialist, comunist thinking Government. To the ones who voted for them [You wanted change, well here we go]

Maybe you forget who else is affected. What about those whose rates go up because you don't have insurance to pay your emergency room bill? What about your wife, husband, son, daughter, father, mother, sister, brother, life partner, employer and co-workers that are hurt when you're sick or injured and no money coming in? Not having insurance is the epitome of selfishness. MAN-UP and do what's right.

This thread should be merged with the other health care thread as the legality of the Bil has already been brought up and discussed a bit at length there.

but if not I will tackle 3 issues here,

1.This Bill has been processed by Congress the same as every other Bill in modern history, the same arguments about how it violates this or that equally apply to all.

So quit trying to use that as a reason to tank one Bill unless you are ready to take on the whole system of PORK BARREL POLITICS and LOBBYING. Which I am if you are because I do agree with you about and it is sad that even the best Laws get filled with that crap.

2. Rights, you will not find any one who beats the drum of Civil Rights harder than I do. But with rights come responsibilities. This is not an Anarchy where it is every man for himself.

Do you really believe you have the right to be unhealthy or treat your body so badly you look like the fat slob the rest of the world thinks Americans are, If it didn't affect me than I would fully agree with you but the FACT is it does affect me. The Bill of rights isn't just about the Government not Violating my rights, it and the laws of the land are there to keep you from violating my rights, which you do by being uninsured or a fat slob. Who picks up YOUR TAB? well when you loose your income because of health problems that could have been prevented, then we have to pay for you to be disabled and even to bury you as you won't be able to afford that.

50% of my income taxes go to social Security and Medicaid according to what is written on my weekly pay stub.

3. illegal Aliens do not qualify for welfare, the act of applying would get them deported. They do contribute to our society, financially, for more on this see my last post in the other health care thread as I go into it at some length about how they pay.

I guess the legality can be discussed in the earlier topic as well: Health Care?, though bear in mind that you're basically saying that Congress and the Senate don't know the Law, so perhaps it's a bit of a sidetrack rather than being relevant to the Healthcare discussion itself.

Due to the posting times, merging the two topics isn't really possible, so I'll close this one and refer to the earlier one to continue this discussion: Health Care? smile3.gif
